Intellectual Property Rights and Access to Affordable ARVs in China (2013)

This paper documents the recent developments, opportunities and challenges in intellectual property rights and access to affordable medicines in China. In particular, the paper finds that there have been impressive achievements in the national response to the HIV epidemic in China. Examples include the rapid expansion of government-supported antiretroviral (ARV) schemes and the development of a legal framework on intellectual property to address access to affordable pharmaceutical products in China. Adoption of the National Intellectual Property Strategy by the State Council in June 2008, and the revisions to the Patent Law and the Implementing Regulations with strong focus on public health protection are among the most prominent legal and policy achievements over the recent years, founding an enabling environment for action. However, there is still a great need for coordination among relevant ministries and agencies to explore options to increase access to affordable pharmaceutical products. The recognition that domestic civil society is a part of the solution is an important starting point to forge broader partnerships necessary to ensure access to affordable medicines and successful treatment uptake. Intellectual Property Rights and Access to Affordable ARVs in China originates from a study commissioned by UNDP to the Third World Network, who conducted the research in consultation with the members of the UN Technical Working Group on Care and Treatment, Access to Medicines Sub-Group in 2007/2008. It was subsequently updated in 2012 with special thanks to UNAIDS, MSF, Hu Yuanqiong and Tenu Avafia, Policy Specialist from UNDP Bureau for Development Policy. The final report was edited by Professor Carlos Correa from the University of Buenos Aires.

Summary of E-discussion on Linkages between Violence-Against-Women and HIV in Asia and the Pacific (2013)

The document presents a summary of the e-discussion on linkages between violence-against-women (VAW) and HIV, which took place from 25 November to 10 December 2012 on the Asia Pacific Community of Practice on HIV, Gender and Human Rights (HIV-APCoP) website, and coincided with the 16 Days of Activism on violence-against-women. The e-discussion was conducted to engage with the HIV-APCoP’s diverse membership of UN agencies, networks of people living with HIV, national and local governments, civil society organizations and academic and research institutions, to inform a Discussion Paper on HIV and violence-against-women that has been commissioned by the Asia-Pacific United Nations Interagency Task Team on Women, Girls, Gender Equality and HIV (IATT). Inputs were sought to identify members views on the linkages between violence-against-women and HIV in the Asia-Pacific region and practical ways of addressing the issue. Over 30 members contributed to an initial online survey and subsequent e-discussion. The full transcript of the e-discussion is available online.

Regional Legal Reference Resource (2013)

This Reference Resource documents key protective laws focused on HIV, men who have sex with men (MSM) and transgender people in five countries in South Asia.
 
The two primary objectives of the Reference Resource are to:
1. build the capacity of legal professionals to analyze protective laws (focusing on people living with HIV, MSM
and transgender people); and
2. develop a resource to support legislative drafting, law reform and advocacy initiatives.

The Time Has Come - Meeting Report (2012)

This meeting report provides recommendations from the Joint WHO/UNDP informal expert group consultation in July 2012 that undertook a review of a draft training package for health providers and for reduction of stigma in healthcare settings. The training aims to enhance HIV, STI and other sexual health services for MSM and transgender people in Asia and the Pacific.

Sex Work and the Law in Asia and the Pacific (2012)

The report is intended to provide an evidence-base for: policy makers working in government, regional and multilateral organizations; parliamentarians; members of the judiciary; civil society organizations; donor agencies; and sex workers and their organizations engaged in advocacy to improve the legal and policy enabling environment for HIV responses. The study focuses on 48 countries of the Asia-Pacific region, with an emphasis on low and middle-income countries.

Lost in Transition: Transgender People, Rights and HIV Vulnerability in the Asia-Pacific Region (2012)

This review examines existing literature on transgender people’s human rights and HIV vulnerability across the Asia-Pacific region. The focus in this report is mainly (though not exclusively) on lower income and middle income countries of the region. This is not to suggest that transgender people in more affluent countries do not experience challenges. On the contrary, they often find themselves excluded from economic opportunities enjoyed by others and end up facing many of the same challenges of survival as do trans* people
in less developed economies.

Summary of E-discussion on Key Affected Women and Girls in Asia and the Pacific (2012)

The primary objective of the e-discussion on Key Affected Women and Girls in Asia and the Pacific, from 1 to 23 February 2012, is to stimulate dialogue to ensure proper policy attention is paid to key affected women and girls in the context of HIV. The network sought input from its members to identify what must be strategized and prioritized to reach the 10 targets of the 2011 Political Declaration, especially targets 1, 3, and 7 that speak most directly to the HIV needs of women and girls. More specifically, the e-discussion sought input to clarify: who members consider to be the key affected women and girls; and what are the priority actions that need to be taken by governments and civil society to achieve the targets regarding women and girls set forth in the Political Declaration, by 2015.

More than 25 contributions were received from nine countries over the e-discussion’s three-week duration. Contributors included UN agencies, government and civil society organizations.

This report documents the presentations and discussions made during the “Making Global Fund Money Work for  Communities: Community Partnership Consultation” held in Pattaya, Thailand on 7-8 December 2011.

It aims to draw attention to the issues associated with how current approaches to Global Fund proposals and grants management processes have hindered grantees’ abilities to inclusively develop and effectively implement rights-based programmes that best serve their communities. The report provides a wide array of recommendations for the Global Fund Secretariat, Board, Local Fund Agents and Global Fund technical partners.

A Review of Socio-Economic Empowerment Initiatives for Women Living with HIV in Asia (2012)

The report, A Review of Socio-economic Empowerment Initiatives for Women Living with HIV in Asia, documents and shares key lessons learned on socio-economic empowerment initiatives for women living with HIV in the Asia region. While similar activities have been undertaken in the region since the early 1990s, few of these have specifically targeted women living with HIV, and documentation of these initiatives is sparse. The report examines the experiences of 10 initiatives in Cambodia, China, India, Myanmar, Thailand and Viet Nam with approaches covering microfinance, vocational training, livelihoods and social enterprises.

The Women and Wealth Project - Empowering Positive Women through Social Enterprises: Results Assessment (2012)

The Women and Wealth Project Results Assessment details the experiences of this innovative pilot project that sought to empower and improve the well-being of women living with HIV through the development of social enterprises that would provide a livelihood and a safe working environment free of stigma and discrimination, build self-confidence and increase community acceptance. The project, implemented by the Population and Community Development Association (PDA) of Thailand and UNDP in close collaboration with networks of women/PLHIV at four sites in Cambodia, India and China, achieved considerable success in empowerment of the women involved. The report also sheds light on unsuccessful experiences and valuable lessons, which could greatly benefit similar initiatives.
